The first situation <br />is the fact that the public hearing for the issuing of the lease <br />to Mountain coal was August 16,1993. We become aware of that <br />meeting on the 17th, the day after when Mark Scancland brought it <br />by the ranch. It appears a deliberate act so to avoid the land <br />owner knowing about this hearing. <br />On September 7, 1993 I was interested in what was happening and <br />it became apparent the lease applications was complete and being <br />forwarded to the power to be in Denver. When we were in your <br />office you said that you wondered why we were not at the public <br />hearing, and with the notification being handed late to us, now <br />you know why we were not there, because it was a deliberate act <br />to let us know about the hearing after the fact. <br />As we discussed our greatest fears are that Mt. Coal does not <br />take care of it's obligations. In July 1992 we discovered that a <br />spring which was the water system to the cabins in Lone Pine <br />gulch had be destroyed by subsidence of over the working of the <br />West Elk Mine. I have requested that Mountain Coal repair the <br />spring or pay damages for the spring so we may attempt the <br />repair. Enclosed you will find the complete information relating <br />to this disaster. In reference to this water situation there is a <br />great amount of fear involve in believing that Mountain Coal will <br />be issued a lease to mine additional coal under our land and then <br />in turn destroy the water systems. We have several spring, stock <br />ponds and reservoirs over the proposed mine areas. See enclosed <br />copies of pictures and the law. <br />Knowing that the past performance of Mountain Coal is to ignore <br />the land owner I believe this disrespect will continue with the <br />next lease. Mountain Coal do not feel any responsibility to the <br />land owner and that they can and will do what ever it takes to go <br />around them and do nothing about the damages that are a result of <br />the mining below the surface. <br />I believe it will be absolutely necessary that mountain coal set <br />
