The first situation
is the fact that the public hearing for the issuing of the lease
to Mountain coal was August 16,1993. We become aware of that
meeting on the 17th, the day after when Mark Scancland brought it
by the ranch. It appears a deliberate act so to avoid the land
owner knowing about this hearing.
On September 7, 1993 I was interested in what was happening and
it became apparent the lease applications was complete and being
forwarded to the power to be in Denver. When we were in your
office you said that you wondered why we were not at the public
hearing, and with the notification being handed late to us, now
you know why we were not there, because it was a deliberate act
to let us know about the hearing after the fact.
As we discussed our greatest fears are that Mt. Coal does not
take care of it's obligations. In July 1992 we discovered that a
spring which was the water system to the cabins in Lone Pine
gulch had be destroyed by subsidence of over the working of the
West Elk Mine. I have requested that Mountain Coal repair the
spring or pay damages for the spring so we may attempt the
repair. Enclosed you will find the complete information relating
to this disaster. In reference to this water situation there is a
great amount of fear involve in believing that Mountain Coal will
be issued a lease to mine additional coal under our land and then
in turn destroy the water systems. We have several spring, stock
ponds and reservoirs over the proposed mine areas. See enclosed
copies of pictures and the law.
Knowing that the past performance of Mountain Coal is to ignore
the land owner I believe this disrespect will continue with the
next lease. Mountain Coal do not feel any responsibility to the
land owner and that they can and will do what ever it takes to go
around them and do nothing about the damages that are a result of
the mining below the surface.
I believe it will be absolutely necessary that mountain coal set
