The attached copy of our application <br />should provide proof as required by the stipulation. <br />I would also like to confirm our telephone conversation <br />of today in•which you agreed that the intake elevation of our <br />principal spillway in Pond No. 1 could be adjusted temporarily <br />by our punching holes at the required intake elevation. When <br />the water levels have lowered and conditions allow, we will <br />make a permanent modification in the structure with a cutting <br />torch. The temporary procedure should allow the sedimentation <br />pond to function as designed. <br />Our apologies for not having completed this modification <br />by the required April 1 date. Until now we have been operating <br />under the mistaken assumption that permit number C-026-81 would <br />not be valid until ratification by OSM. Consequently, some of <br />the dates stipulated in our state permit were overlooked.
