attachment. A legal opinion and mining law explanation from company attorney at Davis
Graham & Stubbs was submitted and is on file with Eagle County Planning.
Current vs. proposed hours of operation including hours and days? Current
and proposed hours remain the same. Trucks begin hauling at 6:30 am and finish the day
at 4:OOpm or S:OOpm with a 30-minute lunch break. This amounts to daily hauling time of
9-10 hours. Normal schedule is on a Mon-Fri basis. Infrequent disruptions due to weather
or equipment breakdowns during the week require the need for an occasional Saturday
haul. Experience at the existing mine site indicates this occurs 3-4 times a year. .
Environmental Assessment CO-140-2001-064EA provides a detailed analysis
showing that the current and future production requirement of 90-100 trucks per day
represents less than 2% of all daily vehicle traffic crossing I-70 at the Gypsum overpass.
Length of haul road from the proposed mice site/ Paved status of haul road.?
The new access road measuring 1.2 miles will intersect the existing haul road at a point 3/<
of a mile from County Road #51. The length of the new road will decrease as mining
progresses down slope. County Road #51 is treated with dust suppressant from the mine
road entrance to the intersection of Highway #6. With the exception of a few steep
sections, the mine haul road is also treated with dust suppressant. Treating steep sections
presents a safety problem because the dust suppressant agent (lignosite) tends to become
slick with rain or snowfall. Untreated sections are controlled with water spray.
Number of trucks/ Description of trucks? The fleet consists of five
tractor/bottom dump trailer units. The trailers are equipped with automatic tarping units.
Stockpile size? Stockpiled ore at the bottom of the mine haul road varies from
30,000 tons to 100,000 tons depending on operational requirements.
Annual ore tonnage requirement? There will be no requirement to increase
mine production from current levels. Maximum production capacity at the wallboard
plant will remain at current requirements in the range of 600,000 tons per year.
Watering schedule/ amounts of water and dust suppressant used? During dry
weather conditions, a 4,000- gallon capacity water truck operates on a continuous basis
during hours of operation. It takes approximately 15-20 minutes to load the truck at the
plant water supply system and the truck is immediately back on the road. The lignosite
dust suppressant is currently purchased and used in the amount of 15,000 gallons per
year. This amount will be increased for necessary usage at the amended project.
16
