Box 483 <br />Paonia, CO 81428 <br />RE: Mine Records for Ongoing Permitting Actions <br />Dear Mr. Bear: <br />This letter is to notify Bowie Resources Ltd. (BRL) that the Division expects all <br />future permit records related to ongoing permitting actions for the Bowie No. 1 <br />and 2 Mines to be made available for public review by placing those records in <br />the Paonia Public Library. The library will replace the Delta County Clerk and <br />Recorder's office as the depository for mine records. BRL should send any <br />records generated by Permit Revisions 2 and 3 from this date forward, to the <br />Paonia Library. <br />As we discussed last week, the Division has received several comments from <br />citizens reviewing proposed permit revisions for the Bowie No. 2 Mine. It has <br />become apparent that the Paonia Public Library is more accessible to local <br />residents than the Delta County courthouse. The library is closer to the mines <br />and most of the parties interested in reviewing proposed mine plans. The library <br />is also open on Saturdays. The librarian indicated that the library would be <br />happy to serve as the depository for mine records. <br />The Division is instructing all of the North Fork coal mine permittees to place <br />future mine records in the Paonia library, rather than the Delta County <br />courthouse. We are doing so in accordance with Rule 2.07.3(4)(a), which <br />requires applicants to make copies of revisions, renewals and permit applications <br />available for public review. That rule indicates that records shall be placed in the <br />county courthouse or "another equivalent public office if it is determined that that <br />office will be more accessible to local residents than the county courthouse". The <br />Division has determined that the Paonia Public Library is more accessible to local <br />residents than the Delta County courthouse. <br />
