A ..r <br />-70- <br />Additionally, the applicant proposes to retain the haul road at the. <br />Wilson-Loudy Load-out as part of the post-mining land use to allow the surface <br />owner to access a gravel pit and farmlands. However, no landowner request to <br />keep the road as part of the post-mining land use was submitted with the <br />application. Therefore, a stipulation is necessary: <br />Stipulation No. 17 <br />WITHIN 60 DAYS OF PERMIT ISSUANCE THE PERMITTEE MUST EITHER REVISE THE <br />RECLAMATION PLAN TO INCLUDE REMOVAL AND RECLAMATION OF THE NORTHERN N0. <br />1 HAUL ROAD AND THE WILSON-LOUDY LOAD-OUT HAUL ROAD OR SUBMIT 7ME <br />INFORMATION REQUIRED BY RULE 2.05.5 FOR POST-MINING LAND USE CHANGE. <br />With satisfactory resolution of the stipulations, the proposed operation will <br />be in compliance with the requirements of this section. <br />XVIII. Subsidence - Rules 2.05.6(6) and 4.20 <br />Information on subsidence can be found in Chapter 5, Yolume VII of the permit <br />application. All mining to date at the Meeker Area Mine has consistetl of the <br />room and pillar method. No appreciable subsidence is projected to occur in <br />previously mined areas due to this limited extraction - high-support method of <br />mining. The mining proposed during this 5-year permit term also consists of <br />only room and pillar mining beneath at least 500 feet of overburden, with no <br />retreat or longwall recovery. Appreciable subsidence is not projectetl to <br />occur. <br />The proposed operation is in compliance with the requirements of this section. <br />XI X. Bonding (Rules 2.05.4(2)(b) and Rule 3) <br />Reclamation cost estimates for the Meeker Area Mines are contained in the <br />Rienau No. 2 Increased Production Modification application volume dated April <br />10, 1981, in volume VII page M-12 and in volume XII (page 19). <br />The Division reviewed the applicant's cost figures, and compared them to <br />figures from the Caterpillar Handbook, Ed. 13, and the Rental Rate Bluebook <br />(1983). In general, cost estimates provided by the applicant were <br />acceptable. Reclamation cost estimates were not provided for the Wilson-Loudy <br />load-out or the Refuse Disposal Area. The Division calculated costs for these <br />areas and has determined that a bond in the amount of ~ 850,000.00 should be <br />sufficient. <br />Stipulation No. 18 <br />WITHIN FIVE (5) DAYS AFTER THE APPROVAL OF THE PERMIT APPLICATION, AND <br />PRIOR TD THE ISSUANCE OF THE PERMIT AN ACCEPTABLE BONG IN THE AMOUNT OF <br />~ 850,000.00 MUST BE DEPOSITED WITH THE DIVISION IN ACCORDANCE WITH CRS <br />34-33-113. <br />With the deposit and acceptance of the bond by the Division the applicant will <br />be in compliance with the requirements of this section. <br />
