MacGuire <br />Lake City Mines <br />Mining Exchange Uuilding <br />8 South Nevada <br />Colorado Springs, Colorado 80903 <br />RE: Golden Wonder Mine - File No. 78-91 ~ <br />Ute Mine - file No. 78-92 <br />Dear Mr. MacGuire: <br />It has recently come to the attention of our Uivision that the Golden <br />Wonder Mine is undergoing an expansion with plans for greatly increased <br />production. Your existing mining and reclamation permit for this <br />operation is for 0.6 acres of surface disturbance under a limited impact <br />permit. This permit also limits you to 70,000 tons or less of annual <br />extraction. Any expansion beyond this limited impact permit is in <br />violation of this permit and the Mined Land Reclamation Act. <br />Please be advised that our Division will plan an inspection of this <br />operation in the very near future. If you are found to be in violation <br />of your permit, the Mined Land Reclamation Board can consider finding <br />such a violation at a regularly-scheduled meeting after said inspection. <br />If a violation is found, the Board is empowered to mandate corrective <br />actions and may issue a Cease and Uesist Order for this operation. The <br />Board, after such a violation is found, may also consider levying <br />possible civil penalties during a formal public hearing. Said civil <br />penalties can be substantial and severe. Section 124 of the Act governs <br />these procedures, and a copy is enclosed for your reference. (You would, <br />of course, be properly notified of all of these meetings.) <br />Although annual fees have been paid for this operation and for the Ute <br />Mine, no notices of intent to continue mining have been received by our <br />Division. These notices should describe the mining and reclamation <br />activities that have occurred at the mine sites and any activities <br />planned for the upcoming year.
