OBSERVATIONS AND FINDINGS <br /> <br />The 18 acre parcel requested for release of liability consists mostly of undisturbed land and a short <br />gravel road and gravel pad, approximately 0.4 acres in total disturbance. Topsoiling and regrading <br />of this minimal disturbance was deemed unnecessary due to the fact that will shortly be redisturbed <br />during the construction of the fairway and putting green slated for this area. The area does not show <br />any signs of erosion and appears to be stable. Construction of the golf course has begun on the area <br />outside of the permit boundary and upon approval of this bond release, will proceed to incorporate <br />this area in the golf course. <br />Summary and Conclusions <br />Based upon a review of the mine permit, the applicant's bond release application, and site inspections, <br />the Division finds that, for this 18 acre parcel, Oakridge Energy has successfully completed all surface <br />coal mining reclamation operations in accordance with the approved reclamation plan and met all <br />requirements of the Act and the Rules. <br />IV. PROPOSED DECISION <br />Based on the observations above, the Division proposes to approve Oakridge's request for a bond <br />liability release for the 18 acre parcel, described below, at the Carbon Junction Mine. This proposed <br />decision will release the applicant from liability for all reclamation work on this parcel. <br />Legal Description of the area requested for release: <br />A tract of land located in Section 33, Township 34% North, Range 9 West, and Section 33, Township <br />35 North, Range 9 West, North of Ute line, New Mexico Principal Meridian, La Plata County, <br />Colorado, being more particularly described as follows: <br />Beginning at the South '/. Comer of said Section 33, T35N, R9W, being an original stone monument; <br />Thence N OS°01'09" W, 520.26 feet; <br />Thence N 85°48'07" E, 1154.56 feet; <br />Thence S 21°31'37" W, 791.07 feet; <br />Thence N 82°02'00" W, 508.12 feet; <br />Thence S 14°06'30" W, 235.92 feet; <br />Thence West 600.00 feet; <br />Thence N 00°59'47" E, 290.55 feet to the south line of said Section 33, T35N, R9W; <br />Thence N 89°50'07" E, 340.01 feet along the south line of said Section 33, T35N, R9W to the point <br />of beginning. Contains 18.340 acres more or less. <br />
