Hagen <br />Office of Surface Mining <br />219 Central Avenue, NW <br />Albuquerque, New Mexico 87102 <br />RE: Sundance Coal Company Revision, File No. C-055-82 <br />Dear Mr. iHt~~~` <br />In response to your letter dated January 9, 1984 concerning the Sundance Coal <br />Company Trailer Park revision, the Division would like to offer the following <br />clarification. <br />The trailer park was initially constructed in late 1982. Topsoil nad been <br />pusned aside to create several pad areas. The Division issued NOV 83-84 in <br />February 1983 for unpermitted activities and for failure to implement <br />appropriate measures to protect topsoil and the hydrologic balance. The <br />operator submitted a technical revision application to bring the trailerlpark <br />into compliance as the abatement for the NUV. <br />The revision indicated that a larger area would be impacted than the original <br />disturbance and additional topsoil would be salvaged. The revision was <br />approved with a stipulation requiring the operator to provide results of ; <br />analyses of the additional topsoil to be stripped in order for the Divisilon to <br />determine whether subsoil and topsoil should be separately stockpiled. After <br />the revision was approved, the management of the mining company changed. The <br />new management was not interested in increasing the area of the trailer park <br />as discussed in the revision. They were interested instead in reclaiming the <br />site. Therefore, people have been gradually moved from the site, no <br />additional disturbance has occurred, hydrologic control measures have been <br />implemented and the operator has remained in compliance since issuance of the <br />revision approval. <br />Currently, no one lives at the site. One remaining trailer will be removed as <br />soon as the access road is passable. The entire site will be reclaimed this <br />spring. Because no additional area has been disturbed and the Company has <br />been reclaiming the site, the stipulation requirements concerning topsail <br />analyses and salvaging at the trailer park do not apply.
