June or July because the same occurrence happened then. I
informed him we were not here in June or July and all we
had was a guard watching the Mill.
Mr. Cale also informed me that he was in his back yard at
10:00pm on Oct. 24th and observed the creek as being dry
at that point, he woke up at 3:OOam went outside to
attend to some personal business, at which time he
observed Cash Creek about to overflow its banks.
Given the volume o? water ~'_iat '.vas bei P_" dis~char¢ed and
±he rela*_ive s?ior? distance would estimate the valves ?o
`-ave ~•eer. ~~pe^ ao ear l; e. --,..t ~1:30Dm the evening of
'J~_t.24th, and no later ±llalz =':COam the morning of
-- - .,~..•.1
_'__ o':..=_e.•,'_rl:a ?n. ~~~ster '_lo.i =_.a.r,;,.ted Jimmy Tatman
`.O wa._f ~he p!D°lil:°_ ~On?1~ai:~ ~:i:_. __!^__:1= ?r~.m .a_ _33n
M.,.. to tli2 tall_:G =^II ~:. 2c .3U~:-.=~ -: ~. ___ _ m~ '. Abeut an
hour later I ran into Bob Mason in front of the
General Store and informed him that we had a prohlem that
we had traced down to a brown valve and Mark Steen was on
his way to shut th_ water off. At 3pDI'o;iim3tely 12:OOam
Mars Steen arrived at the Mili. He then Dointed out to me
that. t1e ~-alve from the t.a_x-ng car.:: rva:= aDen and tn:it ne
had only cracked it open. I then informed him that as soon
as he left the Uroperty I lxad Jimmy turn it off. He then
came to the conclusion that instead of Jimmy r_losing the
valve ha opened it.
In numerous conversations I had with itr. Steen regarding
this matter he has insisted that Jimmy opened the valve,
I informed him that if Mark was not the one that opened
the valve then we have ghosts up here and Casper did it,
Under Mr. Steen's theory that Jimmy inadvertently opened
the valve at noon on Oct.24th, then 480,000 gallons of
water would have showed up in Mr. Coles back yard before
10: OOpm.
One of the e:thibits found in the permit are the results
from the portal was Copper mgil, 0.1700, Zinc
mg/1, 37.4000, Lead mgi1,0.2400, Mercury mg/1,<O.OOOI,PH
solids-dissolved mg/1,1,590, suspended mg/1, <10. I am not
qualified to comment on the damage that occurred but I bet
it didn't help matters any.
#2. As per your suggestion I contacted Mr. Allen Berryman,
