<br />O C B O w P O W E R C O R P O R n T t 0 ~~ <br />Currently, we aze moving forxazd cooperatively with the BLM and U.S. Forest Service <br />on three process-related issues to reduce the risk that the EIS schedule itself (before considering <br />the substance of the EIS) does zot harm future viability. These process-reiated maters include <br />eying to ensure that (i) the sce~~e of the planned EIS does not extend beyond what is reasonably <br />necessary and focuses on common issues that are truly related to cumulative impact; (ii) the EIS <br />schedule moves forwazd as qui:.kly as possible; and (iii) the process for the planned BL~1 lease <br />sales aze conducted and finalize:d (subject to a satisfacivry EIS) on a parallel track while the EIS <br />is being prepazed, so that the ar.tual lease can be finalized as soon as the EIS is complete. <br />We have begun discuss ons with BLM and the Forest Service on an MOU to be signed <br />among the parties that coven Lte EIS process, the lease process and the schedule. To date, these <br />discussions have been quite praductive. In addition, we have taken the initiative and have begun <br />discussions with many of the local groups that are involved in community issues. We aze <br />hopeful that by working together with all of the involved parties, we can reach agreement and <br />move forwazd quickly to the benefit of all. <br />As mentioned above, I ]rave enclosed a series of fad sheets that cover Oxbow and our <br />various businesses, with partic~dar emphasis on the coal mine in Colorado. In addition, I have <br />also included recent correspondence with BLM and the Forest Service, as well as a couple of <br />recent news clips on the subjec: to provide some context. Obviously, the main thrust of the <br />December 15 letter to BLM anti the Forest Service is no longer current, as we have reluctantly <br />accepted the EIS. However, it •ioes provide good background as to why there is relatively little <br />impact from the Ells Creek Trae;t. <br />I would appreciate it if you could take a quick look and call me at 561/640-8856 to <br />discuss.
