Section III <br /> Status of Stipulations <br /> The stipulation history for this site is difficult to follow due to the re-use of stipulation numbers <br /> throughout the life of this site. Stipulations are a binding part of the permit and previously <br /> assigned stipulation numbers are not to be re-used. However, it appears that procedure was not <br /> followed in this case. Investigation of the stipulation response file, revisions to the permit, and <br /> the findings documents indicate the following stipulations are still active, as shown below. It <br /> is assumed that other stipulations issued over the life of this operation have been complied with <br /> or terminated after review of various files and documents maintained for this permit. <br /> Both of the stipulations listed below were issued as a result of the Permit Renewal dated January <br /> 25, 1994. As indicated, both of these stipulations have been satisfied and are no longer active. <br /> Stipulation Brief Description Status Comments <br /> STIP NO. 52 HYDROLOGIC COMPLIED WITH <br /> IMPACTS 3/7/94 <br /> STIP NO. 53 TOPSOIL & COMPLIED WITH SEE TR-37 <br /> REVEG 4/21/94 <br /> The active Stipulations to the permit at the time of this mid-term review, which originated from <br /> previous permitting, are as follows: <br /> Stimulation No. 2(46) <br /> IMMEDIATELY FOLLOWING STREAM CHANNEL RELOCATION <br /> CONSTRUCTION AND BEFORE REROUTING THE PURGATOIRE BACK <br /> INTO ITS PERMANENT BANKS, THE PERMITTEE MUST COMPLETE A <br /> SURVEY OF THE NEWLY CONSTRUCTED CHANNEL. THE COMPONENTS <br /> OF THE SURVEY ARE DETAILED BELOW. <br /> EACH FOLLOWING YEAR, DURING THE MONTH OF FEBRUARY <br /> (COINCIDING WITH LOW-FLOW), THE PERMITTEE MUST RESURVEY ALL <br /> OF THE FOLLOWING REQUIRED COMPONENTS OF THE CHANNEL AND <br /> SUBMIT THIS INFORMATION TO THE DIVISION BY MAY 1ST OF EACH <br /> YEAR. <br /> 1.
