(Civil Action <br />No. H-97-1964 (Southern District of Texas) <br />Dear Mr. Heist and Mr. Getzendanner: <br />Pursuant to my conversation and agreement with Mr. Getzendanner on November 18, 1998, <br />Michael Long's office will produce the documents requested in your subpoena in the above- <br />captioned case by November 24, 1998, rather than the November 20, 1998, date stated in the <br />subpoena. Gregg Squire o:f the Division of Minerals and Geology will have a copy of the <br />documents made and delivered to IKON Office Solutions 370 17th Street, Suite 2000, <br />Denver, CO 80202 by or on November 24. Mr. Getzendanner stated that at this time all the <br />maps included in the Division's public file aze not to be copied and produced. Mr. <br />Getzendanner also underst;Inds that the bill for the copying of the Division's file (no more <br />than 25 cents per page) will be sent directly to him and Mr. Heist from the copying company <br />(Colorado Litigation Support). <br />Please note we have withheld certain documents that are confidential pursuant to statute. egg <br />;§ 34-33-112(9), C.R.S. (information in a permit application relating to location, size, or <br />nature of the deposit, or stlttement or map concerning depth or thickness of the ore body or <br />deposit and thickness and type of overburden to be removed are confidential and are not <br />matters of public records unless operator gives a written release or mining operation has <br />terminated); 34-32-113(3). C.R.S.
