I ~i <br />The following is a brief history of the Hawk's Nest Refuse Disposal <br />Area: <br />January 1, 1977- Lease of land for sanitary landfill between <br />Albert A. Cockroft and Warren R. Cockroft (lessors) and the <br />Board of County Commissioners of the County of Delta (lessee). <br />August 1, 1978- Western Slope Carbon received a CO and NOV <br />for dumping coal refuse at the Crystal Meadows dump site. The <br />Board ordered Western Slope Carbon to submit a plan for refuse <br />disposal by the next Board Meeting on august 23-24, 1978. <br />August 22, 1978- Western Slope Carbon submits a plan for <br />Hawk's Nest waste disposal. The company proposed a slurry <br />pipeline as a long term solution, and the Delta County <br />Landfill as a temporary disposal site. <br />May 21, 1979- An agreement is made between Western Slope <br />Carbon and Delta County to dump coal waste in the vicinity of <br />the landfill. In return for the permission of County and <br />Owner for usage Western Slope agrees to the following: <br />- $6 load of 12 tons or less <br />- $9 load in excess of 12 tons <br />- Comply with lease of 1977 (mentioned above) <br />- No other Coal Company will use the site without prior <br />approval of the County and owner. <br />- Coal company agrees to be responsible for compliance <br />with all laws and regulations pertaining to use of the <br />site as a coal waste dump site. <br />- Terms are for one year, but at the end of the year the <br />parties may mutually agree to extend the term for <br />additional years. <br />The Archive files do not indicated the time frame in which Western <br />Slope Carbon stopped disposing refuse material in the designated <br />area. I believe that this activity started in 1979.__ Suitable <br />subsoil and topsoil are available to reclaim the refuse piles, but <br />Delta County request that they not be reclaimed. <br />It is to my knowledge that Delta County is now the land owner of <br />the said property. The Hawk's Nest Refuse area is not yet zoned <br />for use by the landfill (my guess is that they are working on it). <br />There is roughly 5,000 to 7,000 cubic yards at the Hawk's Nest Mine <br />to be disposed of at the refuse pile (roughly 23 miles away). <br />Legal description of the Refuse pile area: <br />Section 28, T14S, R92W <br />
