Shuey <br />Environmental Protection Specialist <br />Colorado Division of Reclamation ,Mining and Safety <br />101 South 3rd Street, Suite 301 <br />Grand Junction, CO 81501 <br />RE: <br />Dear Mr. Shuey: <br />/N1-~98a-c7y7 <br />Colony Permit M-80-047 <br />Pn~-permit Disturbance ~,,.~ <br />Ron Smith asked me to forwent to you the attached maps that deal with the <br />'talus" mine disturbance on the west valley wall, just noRh of the Colony Lab/Office <br />complex, to document that this disturbance pn:-dates Colony's MLRB Permit. <br />The enclosed copy of the 100-scale site topography (AD-D-001-GC-08-D) shows <br />that Yhis borrow site existed at approximate northing N 659,050 on the west -valley wall <br />as early as Fall 1965. Also enclosed is the cover page from this topo-set (AD-D-001=~--~ <br />GC-0), presenting the airphoto dates (10/29/65 and 12/29165) and'the "legend" for these <br />maps, including the legend symbol for mining activity at this'location. <br />These maps are provided to document my recollection as we discussed in our <br />June 3 , 2007 site inspection, speclfically that this disturbance pre-dates Colony's permit. <br />I reported that the Arco staff_still on site-in-1989 always referred !o that borrow site as <br />"the talus mine", whidt they had used as a borrow site for sand and gravel s¢ed rode <br />material for constructing and upgrading site. roads to the pilot mine and retort <br />constructed in 1965. That time frame pre-dates not onry Colony's MLRB permit, but also <br />pre-dates the MLR Act. Although the map uses the USGS symbol for "mine tunnel or <br />cave entrance", and could have more correctly used the crossed shovels indicating a <br />"gravel, sand or day borrow pit", it is dear that this map confirms what we were told by <br />the Arco hands. <br />ff you have any questions regarding this, please feel free to contact Ron Smith or <br />me.
