Following seeding of the <br />Bite, a minimum 10-year liability period must pass before the site could be <br />released in its entirety. The Division would continue to conduct inspections and <br />you would be responsible for doing any maintenance that is required and <br />conducting quarterly pond inspections and submitting discharge monitoring reports <br />as long as the pond ie on the Bite. To remove the sediment pond, a demonstration <br />proving that the reclamation is adequate to control sediment would be required. <br />This demonstration could not be submitted sooner than two years following seeding <br />of the site. <br />A third option you could select would involve transferring the permit and bond <br />liability to an entity interested in and capable of completing reclamation at the <br />site. This new permittee would be responsible for making the necessary <br />reclamation and bond release demonstrations through the 10-year liability period. <br />Please let me know if there are other options that you would like~the Division <br />to explore with you.
