• A chronology of events related to the processing of the PAP is included <br />with this memorandiun. <br />The Bureau of Land Management recommended approval of the mining plan <br />modification in letters dated November 28, 1986, March 20, 1987, and June <br />16, 1987. The U.S. Fish and Wildlife Service provided its biological <br />opinion under Section 7 of the Endangered Species Act in a letter dated <br />August 4, 1987. The State Historic Preservation Officer concurred with <br />OSMRE's assessment and recoounendations for protection of cultural <br />resources in a letter dated January 7, 1982. <br />The proposed mining plan approval document contains one special condition <br />of approval. Because EEC has provided insufficient information to <br />determine the effects of subsidence on the Yampa and Williams Fork <br />Rivers' alluvial valley floors and certain structures (e.g., Colorado <br />Highway 13 and a railroad spur), the mining plan approval is limited to <br />the area scheduled to be mined during the initial permit term. Mining <br />activities in other areas of the life-of-mine mining area may be approved <br />under a permit revision and mining plan modification at such time as EEC <br />provides sufficient information to Colorado MLRD and OSMRE to determine <br />the effects of undermining these structures and alluvial valley floors. <br />The information in the PAP, as well as other information identified in <br />the decision document included with this memorandum and made available to <br />the applicant, has been reviewed by Colorado MLRD staff in coordination <br />with the OSMRE Project Leader.
