for the Eagle Mines No. S and No. 6 mine subject to the following conditions.
Empire Energy Corporation is hereinafter referred to as the lessee/operator.
Condition 1. Statutes and Regulations.--This mining plan approval is issued
pursuant to Federal coal leases C-30656, D-056298, and
C-0126480; the Mineral Leasing Act of 1920, as amended (30
U.S.C. 181 et se~C.); and in the case of acquired lands, the
Mineral Leasing Act for Acquired Lands of 1947, as amended (30
U.S.C. 351 et se~C.). This mining plan approval is subject to
all applicable regulations of the Secretary of the Interior
including, but not limited to, 30 CFR Chapter VII and 43 CFR
Group 3400, and to all regulations of the Secretary of Energy,
which are now or hereafter in force; and all such regulations
are made a part hereof. The lessee/operator shall comply with
the provisions of the Water Pollution Control Act (33 U.S.C.
1151 et se~C.), the Clean Air Act (42 U.S.C. 7401 et sue.) and
other applicable Federal laws.
Condition 2. This document approves the Eagle Mines No. 5 and No. 6 mine
mining plan, updated through March 18, 1987, and authorizes coal
development or mining operations on Federal lands within the
area of mining play approval. This authorization is not valid
beyond

Condition 3. The lessee/operator shall conduct coal development and mining
operations only as described in the complete permit application
package, updated to March 18, 1987, and approved by the Colorado
Mined Land Reclamation Division, except as otherwise directed in
the coaditions added to this mining plan approval.
