ION III - STATUS OF STIPULATIONS <br />Subsequent to the October 11, 1988 Permit Renewal Stipulation No. 1 and <br />Stipulation No. 2, both regarding revegetation success sampling and standards, <br />were forgiven, as they are now commitments incorporated into the permit <br />document. Stipulations 3 through 8 were complied with during permit terms <br />prior to the 1988 renewal. Stipulation No. 9, regarding the submittal of <br />updated Elk Creek Yard Area Maps, was generated by Minor Revision No. 5 and <br />was complied with on March O1, 1990. Stipulation No. 10, regarding the <br />submittal of a table of summary for Somerset's Small Area Exemptions, was <br />generated by the October 11, 1988 renewal (which was finalized in 1990) and <br />was complied with on February Ol, 1990. Anon-numbered stipulation regarding <br />submittal of an acceptable seed mix was generated by Technical Revision No. 5 <br />and was complied with on March 22, 1990 in the renewal adequacy response. <br />This stipulation will from this day forward be referred to as Stipulation <br />No. 11. <br />There are no stipulations at this time that have not been complied with. <br />SECTION IV - PERMIT VARIANCES <br />The Somerset and Sanborn Creek Mines do not have any variances issued <br />regarding experimental practices, mountaintop removal or contemporaneous <br />reclamation as described in Rules 2.06.2, 2.06.3, and 2.06.7, respectively. A <br />variance to Approximate Original Contour Restoration was issued for the Bear <br />Canyon and Lower Hubbard Creek ventilation facilities as described on <br />pages 2.06-4 through 2.06-10 in the permit document. <br />SECTION V - DECISION TO REQUIRE RE`JISIONS OR ADDITIONAL INFORMATION <br />Please respond to Items 1 through 19 in the form of a Technical Revision. <br />Permit Organization and Consolidation <br />Submit a Table of Contents for written permit documents. Include a <br />complete set for the whole permit to be inserted in Volume 1 and a table <br />to be placed in each volume. <br />2. Submit a new title page with current operator and both mine names. <br />3. Submit updated map and drawing indexes for all volumes. <br />4. Incorporate TR-05 so it is no longer a stand-alone document. Include <br />these materials in the revised tables of contents and indexes requested <br />above. <br />5. If there are sub-sections in a particular section that relate to separate <br />revisions, make the page numbers consecutive for the whole section and <br />distinguish between these sub-sections by listing page numbers in the <br />Table of Contents. <br />6. Submit an updated Identification of Interests according to the new <br />regulations. <br />-3- <br />
