I <br />J <br />Ms. Welt - 2 - May 30, 1991 <br />In regards to the disposition of forfeited bond monies currently being held by <br />the Division for reclamation of the facility, it is our position that <br />forfeited bmd monies are not transferable to a neM permittee and that a new <br />bond would need to be provided to the Division by the new permittee. Portions <br />of the forfeited bond money remaining after all required reclamation work has <br />been completed would either be returned to the principal or, depending upon <br />the situation, be used to satisfy valid claims mark against the principal, <br />In regards to the Division's plans for reclamation of disturbed areas <br />adjoining the silo facil ity, the current schedile is to comp] ete all initial <br />reclamation work by October, 1991. If WECC or the railroad pursue permitting <br />the facility, the Division will reclaim all areas disturbed by the Hawk's Nest <br />mining operation that lie outside of the area included in the new permit. In <br />order to facilitate this, the Division would like to obtain information as <br />soon as possible regarding the specific boundary of areas to be included in <br />the permit for the silo facility. <br />If you have any questions or comments, please contact me at the Division <br />offices. <br />Sincerely, <br />Tan D.
