Atkinson <br />Director of Lands and Environmental Affairs <br />Colowyo Coal Company <br />5731 State Hxy 13 <br />Meeker, Colorado 81641 <br />Dear Mr. Atkinson: <br />The Office of Surface Mining Reclamation and Enforcement (OSMRE) has terminated, <br />effective immediately, Federal permit CO-0015, issued on February 22, 1983, for <br />the Coloxyo mine. The Federal permit was terminated in accordance with OSMRE's <br />Directive on the Termination of Federal Permits xhen the State has a cooperative <br />agreement that delegates the permitting responsibilities on Federal lands to the <br />State. The Colorado Mined Land Reclamation Division (NERD) has issued State <br />permit C-81-019 for the Coloxyo mine in accordance with the Colorado State <br />program and cooperative agreement. <br />I have enclosed the memorandum terminating the Federal permit and the applicable <br />conditions of approval of the Colowyo mine mining plan approved by the Assistant <br />Secretary on February 18, 1983, for Federal leases D-034365 and C-35874. These <br />conditions were previously incorporated in the Federal permit. <br />Colorado MLRD is now the regulatory authority for surface coal mining and <br />reclamation operations on Federal lands at the Colowyo mine under Colorado State <br />permit C-81-019, the Colorado State program, and the cooperative agreement. <br />Mining operstions on Federal leases D-034365 and C-35874 must be conducted in <br />accordance xith the approved mining plan, the leases, the Mineral Leasing Act of <br />1920, as amended, and its implementing regulations, as well as the State permit. <br />If you have any questions, please contact Rick Williamson at (303) 844-2915. <br />Sincerely, <br />~~=~~ O <br />R~ngh, Chief <br />Federal Lands Branch <br />Enclosu/res <br />cc: /Gregg Squire, MLRD <br />R.
