Findings <br /> 1. The Division finds that a properly executed Request for Transfer of Coal Permit and <br /> Succession of Operators application form has been submitted to the Division in <br /> compliance with Rule 2.08.6(2)(b). <br /> 2. The Division finds that properly executed Surface Coal mining and Reclamation Operation <br /> Reclamation Bond has been posed by the successor operator as follows: <br /> Letter of Credit #SM-03511-096 for $1,099,743.75. <br /> 3. The Division fmds that the Identification of Interests information required by Rule 2.03.4 <br /> has been properly submitted, reviewed and deemed adequate as required under Rule <br /> 2.08.6(2)(b)(iii). <br /> 4. The Division finds that the Compliance Information required by Rule 2.03.5 has been <br /> properly submitted, reviewed and deemed adequate as required under Rule <br /> 2.08.6(2)(b)(iii). <br /> 5. The Division finds that the Right of Entry and Operation Information required by Rule <br /> 2.03.6 has been properly submitted, reviewed and deemed adequate under Rule <br /> 2.08.6(2)(b)(iii). <br /> 6. The Division finds that the Waiver Information required by Rule 2.03.7(3) has been <br /> properly submitted, reviewed and deemed adequate under Rule 2.08.6(2)(b)(iii). <br /> 7. The Division fmds that the Personal Injury and Property Damage Insurance Information <br /> required by Rule 2.03.9 has been properly submitted, reviewed and deemed adequate <br /> under Rule 2.08.6(2)(b)(iii). <br /> 8. The Division finds that the Identification of Other Licenses and Permits required by Rule <br /> 2.03.10 has been properly submitted, reviewed and deemed adequate under Rule <br /> 2.08.6(2)(b)(iii). <br /> 9. The Division finds that, based upon all available information, Oxbow Carbon and <br /> Minerals, Inc. and all related owners and controllers of said company are currently in <br /> compliance with rules 2.07.6(1)(b) and 2.07.6(1)(c). <br /> The Applicant Violator System (AVS) was checked by the Division on May 15, 1996, <br /> July 3, 1996, October 2, 1996 and February 20, 1997. The evaluation resulted in AVS <br /> recommendations to approve Oxbow Carbon & Minerals Inc. as the successor operator <br /> for Permit No. C-81-022. The Office of Surface Mining Regulation and Enforcement <br /> (OSMRE) AVS recommendation is also to approve the transfer application. <br />
