Dale P.eam <br />Cooley Gravel Company <br />21l Larch 1975 <br />Page ~+ <br />shall be deemed to be objectionable when: <br />a. ar.~ong a sample of persons exposed to it, at <br />least 20~ of said. sa^!ple, but in no case fewer <br />than five persons, determine that it is offensive <br />and that it obstructs or ~_nterferes with the <br />reasonable and comfortable use and enjoyment of <br />property, or <br />b, sampli;;~ or other reasonably definitive <br />observation demonstrates tr,at an amount of <br />fugitive dust is beir~ or ha_s been transported <br />off of t!ie property of the operations oni;o <br />another•'s property so as to obsturct or interfere <br />with -tl-,e reasonable and comfortable use ~~.nd <br />enjoyment of property. <br />"3. ,tihen not fever than five complaints of objeci;ienable <br />fugitive dust are registered with the Division, and <br />earlier at the option of the Division, it shall be <br />the resronsibility of the Division to investigate <br />the complaints to determine if a violation of -Phis <br />regulation has occurred and. to identify the source <br />or sources of the fugitive dust and the circumstances <br />surrounding its emission." <br />In a letter from the Jefferson County Health Departm~:nt to <br />Cooley Gravel Company it was found that "the inspection <br />conducted on October 31, 197• revealed ne violations of <br />emission standards as set forth by the Colorado Air Pollution <br />Control Commission" (see enclosure). The accompanyv~g <br />inspection a~or•l:sheet cites dust control factors such as; <br />delayed sequential blasting and Johnson;~[arsh dust coni;rol <br />equipment, <br />It was found that there have never been any ccmpla.ints on <br />record with either the Jefferson County or State of ~%olorado <br />Health Departments, Furthermore, T:ir.
