STATE OF COLORADO
DIVISION OF RECLAMATION, MINING AND SAFETY
Department of Natural Resources
1313 Sherman S[., Room 215
Denver, Colorado 80203
Phone: (3037 866-3567
FAX: (303) 832-8106
DATE: July 2, 2007
COLORADO
DIVISION OF
RECLAMATION
MINING
- &-
SAFETY
Bill Ritter, Jr.
INTERNAL MEMORANDUM c°°en'°r
Harris D. Sherman
Executive Director
Ronald W. Cattany
Division DireROr
Natural Resource Trustee
TO; Jill McLemore and Jay D Trujillo
FROM: Dan Mathews
RE: Payment to Castleton Ranch for OC #2 Mine Work
Permit No. C-1980-002
Enclosed please find letter dated June 27, 2007, from Randall W. Pool, Ranch Foreman
for Castleton Ranch, along with substitute form W-9, submitted by Mr. Pool. Castleton
Ranch is the surface landowner of the revoked OC #2 coal mine. I have had discussions
over the past year with Mr. Pool, and his predecessor as ranch manager, Tom Sanders,
regarding fence maintenance and weed control work that Castleton Ranch has agreed to
perform at the 3 acre (approximate) site. The work schedule and dollar amounts listed in
Mr. Pool's letter accurately reflect our previous discussions, and it is my understanding
from previous discussions with Jill, that the Division can directly reimburse Castleton
Ranch from the forfeited bond account, for this work.
Based on inspections that I conducted at the site on October 12, 2006, and June 29, 2007.
the fence work and weed spraying that should have been conducted to date, has been
properly completed. Mr. Pool has requested reimbursement of $400.00 for the work
completed, which is reasonable and reflects our previous discussions. Mr. Pool has
requested an additional $300.00, for fence maintenance and weed control activity that
Castleton would perform over the next three years (2007, 2008, and 2009). Given the
small dollar amount and the good faith that Castleton has exhibited in working with the
Division to protect and improve reclamation at the site, my preference would be to
"advance" them the $300.00, and issue a check for the entire $700.00, rather than having
them bill us each year for $100.00, if that is allowable. If not, please proceed with
issuance of a check in the amount of $400.00, and I will advise Mr. Pool of the need to
bill us for the $100.00 on an annual basis for the next three field seasons.
Please let me know if you need anything more from me.
Office of Office of
Mined Land Reclamation Denver Grand Junction Durango Active and Inactive Mines
