T. Massey recently entered into a Compfehensive Agreement (File No. OCA-19405-115) <br />with the Kentucky Natural Resources and Environmental Protection Cabinet relative to Massey <br />and its subsidiaries operating in Kentucky grid aSite-Specific Agreed Order (File No. OCA- <br />19421-115) related to Catawba Industries, Permit No. 898-0140. <br />The agreements require that Massey and its subsidiaries update all of their permits to include <br />Catawba Permit No. 898-0140 as an operation they controlled. Accordingly, we ask that the <br />attached supplemental information be inserted into each permit file as necessary to meet the <br />permit update provision of the agreements. <br />This submittal is being made simultaneously to all states except Tennessee in which A. T. <br />Massey subsidiaries operate and the collective submission covers all permits held by those <br />companies.
