<br />LAC MINERALS (USA) INC. <br />MINE PERMIT NO. 4d5 <br />AMENDMENT CONDITIONS <br />1. The conditional approval of this amendment hereby incorporates by reference those <br />representations made by LAC Minerals, as to plans, specifications, operations, <br />environmental impacts, and reclamation as contained in the amendment submitted on <br />December 31, 1992, with supplemental information submitted on January 7, 8, 13, and <br />26, 1993, and December 6, 10, 13, 15, 16,. and 17, 1993. The representations contained <br />in these documents are general conditions of this amendment to the permit unless modified <br />by a.future technical revision, amendment or permit, or modified by other conditions as <br />may be imposed by the Board of Ivimerals and the Environment. <br />2. This amendment and all rights under such one expressly conditioned on the truth of <br />representations made by the applicant, LAC Minerals, its officers, and employees in the <br />application and supporting. documentation relating to the application. Should any such <br />material representation prove to be false, this amendment and all rights under such may <br />be canceled upon such fmding by the Board. <br />3. This amendment is conditioned upon compliance with all applicable laws and regulations. <br />4. T'he operation shall be conducted in compliance with all Lawrence County Zoning <br />• Requirements and Conditional Use Permit conditions. <br />5. All monitoring systems presented in the application or as modified by the Board shall be <br />followed. Any changes in these monitoring systems must be approved by the DeparUnent <br />through technical revisions. <br />Leachate discharge or surfacC water runoff from the tce of the waste rock left in the South <br />Waste Dump shall not cause South Dakota Surface Water Quality Standards, South <br />Dakota Groundwater Quality Standards, or NPDES permit requirements, as applicable, <br />to be exceeded. <br />2. To further prevent the possibility of acid mine drainage from the waste rock left in the <br />South Waste Dump, waste rock having a net acid generating (NAG) pH of less than 3 <br />indicative of an Acid Base Accounting (ABA) of less than -5 tons of calcium carbonate per <br />kiloton of waste material (T/KT CaCO~, and also having a paste pH of less than 4.5, shall <br />
