<br />threaten the integrity of the clay layer shall be removed, noxious weeds shall be controlled, <br />and burrowing animals shall be controlled. These maintenance activities will be done <br />during the quarterly inspections or on an as-needed basis. <br />11. To ensure that food Mined Land Reclamation Plan goals are achieved as specified in this <br />permit amendment, a biological monitoring plan for the postclosure period must be <br />developed and implemented by LAC Muterals, Inc. Based on the biological monitoring <br />plan, an aquatic restoration plan may be required. T1re biological monitoring plan shall <br />provide for monitoring of biological communities for this site during the postclosure <br />period. The postclosure biological monitoring plan shall be developed following oversight <br />and approval of the Department of Game, Fish and Pazks and the Department. This <br />monitoring plan shall be submitted prior to the start of the postclosure period. The <br />monitoring plan shall be submitted W the Department of Game, Fish and Pazks and the <br />Department for approval and inclusion as an addendum to the Mined Land Reclamation <br />Permit Amendment to Mine Permit No. 445. This issue shall be assessed on an annual <br />basis by the Department of Game, Fish and Pazks and LAC Minerals at the annual <br />performance monitoring meeting described in the Performance Monitoring section of these <br />conditions. <br />11. The South Dakota Department of Game, Fish and Parks, in consultation with the <br />Department, may require additional surface water monitoring regimes, parameters, and <br />intervals to augment biological monitoring objectives for the postclosure period. <br />poc rloc ire Fin n .ial Acc iranrr <br />1. LAC Minerals shall submit postclosure financial assurance in the amount of 51,700,000 <br />for postclosure care for the mine site including the waste impoundment, South Waste <br />Dump, and the leach pads. 'It-e postclosure financial assurance need not be submitted until <br />LAC Nfinerals gives notice that postclosure care is to begin. As phases of reclamation are <br />completed, and the associated reclamation surety is released, LAC Minerals may have the <br />reclamation surety transferred to become postclosure financial assurance. However, in no <br />way shall the reclamaflon surety be reduced below the amount of the postclosure financial <br />assurance until the postclosun: financal assurance is submitted. The postclosure financial <br />assurance will be used to correct postclosure problems in the case of operator default, <br />bankruptcy, etc. The postclosure financial assurance amount will be reviewed and <br />recalculated by the Department at the time of mine closure. <br />2. The postclosure financial aecnraoce shall be held for a period of 30 years after reclamation <br />surety release to ensure that the affected land is stable, is free of haiards, has self- <br />generating vegetation, has minimal hydrological impacts, has minimal releases of <br />substances that adversely impact natural resources, and is maintenance free to the extent <br />practicable unless the Board modifies the Sength of the postclosure period. If the Board <br />finds that an extension of the postclosure period is necessary, the postclosure financial <br />assurance, or portion thereof necessary to ensure continued compliance, shall be held for <br />13 <br />
