• ` i <br />,/ <br />Bankruptcy Judge, on Wednesday, July 14. 1993, at the hour of <br />2:00 o.m., or as soon thereafter as counsel may be heard, ire <br />Judge Boulden's Courtroom located on the third floor of the <br />Federal Courthouse Building located at 350 South Main Street:, <br />Salt Lake City, Utah. The Motion requests approval of a <br />settlement of this adversary proceeding between the parties. <br />CF&I brought this action against Defendant alleging that cex•tain <br />transfers made to it constitute avoidable preferences under 11 <br />U.S.C. § 547(b). The parties have agreed to settle the matter <br />with Defendant making a payment of $4,500.00 and being permitted <br />to file an unsecured claim in the same amount or an amended <br />unsecured claim including such an amount. Copies of the Motion <br />and the related settlement agreement may be obtained by request <br />from the undersigned counsel for CF&I. <br />PLEASE TAKE FURTHER NOTICE that, pursuant to Rule 52'_~(b) <br />of the Rules of Practice of the United States Bankruptcy Court <br />for the District of Utah, objections to the Motion must be <br />submitted in writing, filed with the Bankruptcy Court, and :served <br />upon the undersigned counsel on or before Friday, the 11th clay of <br />June, 1993. Absent timely filing and service of objections, the <br />hearing may be stricken and the relief sought in the Motion may <br />be granted by the Court without further notice or hearing. <br />Additionally, upon the resolution of any timely filed and served <br />objections, the hearing may be stricken and the relief sougY~t in <br />2 <br />
