The mine has not <br />expanded closer than 750 feet of your home. At that point there is <br />approximately 450 feet of rock between the coal seam and tie ground <br />. surface. With this information, it 1s possible to project the angle of <br />.draw (the surface area which would be impacted due to extraction). <br />Although actual angles of draw are measured at about 22°, we have <br />utilized a much more conservative projection of 30°. This means that <br />more surface area would be disturbed using 30° rather then 22°. <br />Based upon our analysts, it is apparent thet, given the current extent of <br />mine development. surface disturbance would not be observed closer than <br />403 feet from your home. In other words. subsidence should not be <br />occuring more than 347 feet Prom the mine area, and would not come within <br />403 feet of your homd: <br />Furthermore, as roam and pillar mining under the Purgatory River was <br />conducted with only 50Y extraction, no subsidence is expected to occur. <br />Therefore. it does not appear that the damage to the adobe structure was <br />caused by mining-induced subsidence. <br />3. Mine Exhaust <br />J <br /> <br />The Division has provided several Responses to concerns raised by <br />yourself and others regarding mine exhaust north of the Purgatory River. <br />We believe the statement in your letter that you "are not getting a <br />response" is somewhat inaccurate, and that 1t is probably important at <br />this time to document the history of the Dl vision's responses to this <br />particular issue. ' <br />On November 5. 1992, Dl vision personnel received a telephone call from <br />Mr. Michael A. Ossala with the Las Animas County Planning and Land Use <br />Office. Mr. Ossola informed us of concerns by Mr. Charles Baldwin with <br />the exhaust from the Golden Eagle mine fan, si wated north of the <br />Purgatory River, impacting vegetation in the area. Mr. Ossola lncpected <br />the site sometime between October 27, 1992 and November 5. 1992 with Mr. <br />John Martinez of the Las Animas County Health Department. We asked Mr. <br />Ossola to provide us with a copy of Mr. Bnldwin's letter. which we <br />received on November 17. 1992. <br />On November 6, we contacted Basin Resourxes regarding the November 5 <br />telephone call from Mr. Ossola. On November 12, we contacted by <br />telephone Ms. Cathy Rhodes with the Stationary Sources Section of the Air <br />Pollution Control of the Colorado Department of Health, to discuss this <br />situation.
