iiiiuiiiiiiiiuiii
HARRISON WESTERN
CORPORATION
October 8, 1992
Mined Land Reclamation Division
Department of Natural Resources
Attn: Mr. Steve Renner
1313 Sherman St., Room 215
Denver, CO. 80203
Dear Mr. Renner,
~~~~i'vf_:;
OCT 131992
Divisiuw ;-,
MINERALS & iiEU! ~.'.••
The following letter is offered to document the ongoing efforts by HWC
over the past four months to meet the requirements of the compliance
agreement signed on April 22, 1992 and to address the N.O.V. issued on
July 28, 1992.
HWC started the required work during the week of June 1 and completed
the outlined items by June 13, 1992. MLRD inspected the work on June
11 as documented in the coal inspection report of June 11. It was
pointed out that some items needed more attention, although the
majority of the required items were deemed to be adequate, including
the installation and location of the Diversion Ditch and Culvert.
The next inspection my MLRD took place on July 1, 1992, two weeks
after the completion of the required work. The report was primarily
directed at the revegetation aspect of the compliance agreement,
although the report pointed out some items which needed additional
work in order to complete the requirements. The most notable item
being the lower Rock Check Dam and its relationship to the Diversion
Ditch. In response to the concerns of the July 7, 1992 report HWC
arranged for the areas where the seed and straw had blown away to be
reseeded and additional mulch laid. There was also some hand work
completed on tite lower Rock Check Dam as it was not possible to get
any type of equipment into the side. This work took place during the
period of July 6-9.
The next inspection by MLRD took place on July 16, 1992 approximately
2 weeks after the last inspection. This report addresses the pond and
the Diversion Ditch, and primarily discusses the pond volume
requirements. For the first time, it was pointed out that the pond
must be of a size to accommodate 1.14 acre feet of water, which has
been determined by MLRD to be the appropriate size for a 10 year 24
hour event. The determination was made a full month after the work
was completed by HWC and after the initial inspection was conducted
during the time of the initial work. The report also points out that
a primary spillway must be opened again. This is the first time this
requirement has been addressed. The Diversion Ditch was
4860 Robb Street, Suite 101, Wheat Ridge, Colorado 80033 •1303) 467-1239
FAX (303) 467-3668
