Cattany <br />Alamosa, CO 81101 ~ ARing Division Director <br />,.~ <br />Re: Peat Mine, Permit M-1994-081, Possible Unpermitted Disposal of Solid Waste at Permitted Site. <br />Dear Mr. Barrier, <br />On October 7, 2002 this office received a copy of a letter addressed to you from the Solid Waste Unit of <br />the Colorado Department of Public Health and Environment (CDPHE}, in which a significant amount of <br />solid waste had reportedly been disposed of in the permitted peat mine. The CDPHE informed you that <br />the current conditions of this disposal site may be in violation of State solid waste laws. <br />This letter is to inform you that if the disposal of solid waste is actually located within the boundaries of <br />the DMG permit area, there a potential problem ofnon-compliance with your approved mining plan, <br />approved reclamation plan, and your permit. In addition, the carrying out of such practice in your DMG <br />permit area boundaries may contribute to a condition of being under-bonded for the final reclamation of <br />the site. <br />Please be aware that the activities and land area described in the CDPHE letter may be under the <br />jurisdiction of DMG also, within the content of the topics listed in the paragraph above. At this time, <br />though we have been notified of this possible condition, this is not being regarded as a "complaint." <br />However, it is currently being regarded as a problem with the records for your permitted site, which may <br />be corrected in one of several ways. Your options for satisfactorily correcting this problem will depend <br />on the conditions which presently exist, and if there are any permit modifications you wish to implement. <br />At the present time, this office requests that you send copy of any pertinent correspondence you write in <br />reply to the CDPHE letter, in which you either refute, clarify or agree with the claims stated therein If <br />you do not submit to DMG a copy of your response to that letter within 30 days of the date of this letter, <br />you must submit a written response specifically to DMG describing the situation and conditions <br />pertaining to those in the CDPHE letter, within the same 30-day timeframe. <br />If no response is received within 30 days, this office will schedule an onsite inspection, for purposes of <br />checking for any topics ofnon-compliance with your permit. Please be reminded that if you do not <br />respond to this letter in a timely or adequate manner, possible enforcement action may result. <br />There are at least two possible solutions to this situation. One, if you do not wish to pursue the use of this <br />site as a legal, permitted landfill, would be the complete removal and proper disposal of the solid waste in <br />
