Long, <br />Division Director <br />The Division received your letter on May 18, 1992 regarding a letter received <br />by your office on April 24, 1992 from Dr. W.D. Corley, Jr. We have reviewed <br />your letter and would like to respond to your requests for additional <br />information. <br />Enclosed are portions of the Financial Warranty document submitted by Harrison <br />Western Corporation to the Division on October 18, 1982. Harrison Western <br />submitted this warranty when they considered developing underground entrances <br />from the West Pit of the GEC Mine into the immediately adjacent Newlin Creek <br />Mine (Permit No. C-81-045). These document copies identify a portion of the <br />"West Pit" as Harrison Western's original area of financial warranty <br />obligation. <br />The outline of the original area of obligation has not changed in the <br />compliance agreement established between the Board and Harrison Western. What <br />has changed is its location. On April 8, 1992, a survey was conducted by the <br />Division and attended by Dr. Corley and Bob Williams of Harrison Western. <br />This survey demonstrated that approximately half of the 1.55-acre area of <br />obligation as shown in the financial warranty document was situated on <br />undisturbed land. In addition; the majority of the existing disturbed area <br />lay to the east of the area of obligation. As such, moving the area of <br />obligation slightly to the east brought the survey more in line with actual <br />on-the-ground disturbance. Due to the readjustment, the Harrison area of <br />obligation entirely encompasses reclaimed lands, thus increasing the area of <br />actual liability. <br />Since the end of last month, we <br />concerns raised by Dr. Corley in <br />response to Dr. Corley regarding <br />addition, will make our decision <br />diversion ditch disturbance, and <br />Dr. Corley. <br />lave been investigating several of the <br />your letter.
