Dept of Natural Resources <br />DEPARTMENT OF NATURAL RESOURCES <br />IN THE MATTER OF: <br />Empire Energy Corporation, <br />Eagle No. 9 Mine <br />FORMAL HEARING: <br />FINDINGS OF FACT AND DECISION <br />This matter was presented in a formal hearing, after proper notice, before the <br />Colorado Mined Land Reclamation Board ("Board") on May 24, 1984, in Room 110 <br />of the Centennial Building, 1313 Sherman Street, Denver, Colorado. The Board <br />conducted the hearing at the request of Axial Basin Ranch Company and W.F. <br />Simpson, regarding the Division's proposed decision to approve mining in the <br />Eagle No. 9 Mine. <br />A quorum of the Board was present during the entire hearing and participated <br />in deliberation and voting on the matter. Ms. Dicky Lee Hullinghorst, <br />Chairman of the Board, presided. Other Board members in attendance were <br />Sherman Bloch, Davis C. Holder, Terry O'Connor, Chips Barry, Lee Campbell and <br />Margaret Winter. The hearing was held in accordance with C.R.S., 34-33-119(5) <br />and 2 CCR 407-2, Rule 2.01.4(3)(b). A taped transcript was made of the <br />hearing. <br />Pursuant to the authority vested in the Board by C.R.S., 34-33-119(5) and 2 <br />CCR 407-2, Rule 2.07.4(3)(b), the Board hereby makes the following findings of <br />fact and decision. <br />FINDINGS OF FACT <br />The Mined Land Reclamation Division ("Division") received a permit revision <br />application for mining in the Eagle No. 9 Mine from Empire Energy Corporation <br />("Empire") on October 31, 1983. The permit revision application addressed the <br />subsidence and hydrologic concerns which prevented the Division from granting <br />approval to conduct mining operations in the Eagle No. 9 Mine in September, <br />1983 when the Eagle No. 5 Mine was approved. <br />Findings of compliance proposing to approve mining in the Eagle No. 9 Mine <br />were issued by the Division on April 9, 1984. The proposed decision was <br />published in the Northwest Colorado Daily Press on April 13 and 20, 1984. <br />
