The September 12, 1983 letter <br />from the Division indicated that Powderhorn Coal Company had to apply for <br />reissuance of the permit not less than 180 days prior to the expiration date. <br />Powderhorn Coal Company responded to the Division's request on December 28, <br />1983 with a permit renewal and modification application package. <br />Powderhorn Coal Company, as stated in the December 28, 1983 submittal, planned <br />to use the mine dewatering discharge point as early as April of 1984. However, <br />because we have neither received a permit from the Division nor any information <br />with regards to completeness of the renewal and modification application, Powder- <br />horn Coal Company has elected not to utilize the previously permitted dis- <br />charge point. We contacted Mr. Don Simpson of your office on this matter <br />and we have been advised that Powderhorn Coal Company cannot currently use <br />the discharge point because the existing permit does not reflect actual <br />field conditions (a mine dewatering discharge point). <br />We understand that the permit is in "typing" and that generally a permit <br />becomes effective thirty (30) days after the date of receipt. Powderhorn Coal <br />Company is now faced with expiration of the permit at midnight June 30, 1984. <br />The lapse time in permitting, between an expiration date (i.e., June 30, 1984) <br />and when the permit is finally renewed, is of great concern to Powderhorn <br />Coal Company. We understand that during the lapse time a notice of violation <br />can be issued for discharging without a permit. <br />The timing involved for reissuance is important to Permit No. CO-0036617 <br />and would be critical for Powderhorn's Permit No. CO-0027146. <br />POWDERHORN COAL COMPANY • P.O.
