NOV C-93-039 - Issued for the permittee's failure to (1) <br />install a culvert where an access road crossed a clear water <br />diversion ditch, (2) route coal silo drainage to a sediment <br />pond rather than into a clean water diversion, (3) prevent <br />oil and gas spills, and (4) protect a stream buffer zone <br />from windblown coal dust generated by coal processing <br />operations (4/5/93 inspection). <br />6. NOV C-93-044 - Issued for the permittee's failure to <br />stabilize access road embankments with a vegetative cover to <br />minimize erosion (4/5/93 inspection). <br />7. NOV C-93-058 - Issued for the permittee's failure to pass <br />disturbed area drainage through a sediment pond at nine <br />locations and for the permittee's failure to maintain 3 <br />ditches, one berm, and one culvert (4/12/93 inspection). <br />8. NOV C-92-049 - Issued for the permittee's failure to <br />maintain the inslope of sediment pond 007 and the required <br />1.0 feet of freeboard in impoundment 006, said lack of <br />freeboard resulting in an overspill (4/12/93 inspection). <br />9. NOV C-93-061 - Issued for the permittee's failure to <br />maintain three small area exemptions (4/12/93 inspection). <br />In addition to these nine NOVs, seven other NOVs were written for <br />the permittee's failure to comply with various non-related <br />Performance Standards. These seven other Notices of Violation <br />are: <br />10. NOV C-93-034 - Issued for the permittee's failure to display <br />proper mine identification signs, surface disturbance <br />perimeter markers, stream buffer zone markers and topsoil <br />pile markers in eleven different locations, as well as along <br />the mine's surface disturbance perimeter (4/5/93 <br />inspection). <br />11.
