Box 9 <br />Craig, Colorado 81626 <br />Re: Beaver Brothers, Inc., Moon Pit No. 2 Pit, File M-77-443, Possible Temporary <br />Cessation <br />Dear Mr. Peck: <br />We recently reviewed the Moon Pit No. 2 Pit Annual Report that you sent in on <br />behalf of Beaver Brothers, Inc. and the Moffat County State Bank. The report <br />indicated that the site has been inactive for at least six months. Please refer to <br />the Minerals Rules and Regulations Sections 1.6.2 and 1.6.2(2)(a) which state that <br />if an operation ceases production for a period of 180 days or more, the operator <br />must file a Notice of Temporary Cessation with the Board. This notice Host state <br />the date of cessation, the reasons for cessation, a plan for the resumption of <br />mining, a description of those activities the operator will take to ensure <br />compliance with the permit reclamation requirements and a description of site <br />maintenance activities to ensure compliance with the performance standards (Rule <br />6). The Notice of Temporary Cessation should be sent to the Division separate from <br />other correspondence. <br />As an alternative to temporary cessation, you may amend your permit to indicate <br />that the operation will be intermittently active throughout its life. The <br />amendment application must include a description of those activities the operator <br />will undertake to ensure compliance with the permit reclamation requirements, and <br />description of the site maintenance activities which will ensure compliance with <br />the performance standards (Rule 6). Rule 1.6.2 (2)(d) addresses this amendment. <br />Since the annual report indicated that operations have temporarily ceased, you <br />should submit either a request for temporary cessation or a permit amendment within <br />the next 45 days. If the request indicates that the site is sufficiently <br />stabilized, we will approve the request for cessation within sixty d,~ys. If the <br />request indicates that there may be some problems with the site, we will either <br />request more information from you, or schedule the site for an inspet:tion.
