<br /> <br /> <br /> <br /> <br />1 <br /> <br />1 <br /> <br />1 <br />1 <br /> <br /> <br /> <br /> <br />1 <br />1 <br />1 <br /> <br />1.0 INTRODUCTION <br />On August 20, 1999 the Colorado Department of Public Health and Environment (CDPHE) <br />issued a Notice of Violation (NOV) and Cease and Desist Order (CDO) to B~cttle Mountain <br />Resources, Inc. (BMRI) alleging the discharge of groundwater from the partially backfilled West <br />Pit at the San Luis Project. Item 2 of the CDO states that BMRI must "Within 30 days after <br />issuance of the Order, notify the Division in writing as to what measures will be taken to ensure <br />that no further illegal dischazges occur from the West Pit." Accordingly, this response plan has <br />been prepazed to summarize the measures BMRI has taken and intends to take to comply with <br />the requirements of the CDO. <br />The response plan presented herein is based primarily on the information developed in the <br />document entitled "TR-26 Water Management in the West Pit Area San Luis Project, Costilla <br />County, Colorado (hereafter "TR-26")" that was submitted on Mazch 22, 1999 to the Colorado <br />Division of Minerals and Geology (DMG), and later modified in the document entitled <br />"Technical Review Comment Response TR-26 Water Management in the West Pit Area San <br />Luis Project, Costilla County, Colorado:' Both of these documents have been submitted <br />previously to CDPHE and aze incorporated herein by reference. <br />1.1 Purpose of the Response Plan <br />This document is submitted to the CDPHE in response to the NOV/CDO issued to BMRI on <br />August 20, 1999. BMRI has implemented, and will continue to implement, measures to control <br />the flow of groundwater from the West Pit into the adjacent Rito Seco alluvial aquifer. The <br />approach outlined in TR-26 serves as the fundamental technical basis for this operative plan. <br />This document specifies the interim and long-term technical actions that BMRI will implement <br />to address the West Pit water both within the pit backfill and in the Rito Seco alluvial system. <br />These response actions consist of: <br />1. Submittal of a CDPS permit application which covers both the operation of a longer <br />term active water treatment facility with dischazge to the Rito Seco as well as the <br />alluvial groundwater seepage front associated with the West Pit (submitted August <br />20, 1999) <br />Basle Mountain Resources, Inc.
