Chemicals Company, Inc. ("Vulcan"), will be heard by the <br />Honorable Judith A. Boulden, United States Bankruptcy Judge, on <br />Wednesday, September 29. 1993, at the hour of 3:00 o.m., oz as <br />soon thereafter as counsel may be heard, in Judge Boulden's <br />Courtroom located on the third floor of the Federal Courthouse <br />Building located at 350 South Main Street, Salt Lake City, Utah. <br />The Motion requests approval of a settlement of the above- <br />captioned adversary proceeding between the parties. CF&I brought <br />this action against Vulcan alleging that certain transfers made <br />to it constitute avoidable preferences under 11 U.S.C. § 54,7(b). <br />The parties have agreed to settle the matter with Vulcan me~king a <br />payment of $3,250.00 and being permitted to file an unsecured <br />claim in the same amount or an amended unsecured claim including <br />such an amount. Copies of the Motion and the related Settlement <br />Agreement may be obtained by request from the undersigned counsel <br />for CF&I. <br />PLEASE TAKE FURTHER NOTICE that, pursuant to Rule 5:!3(b) <br />of the Rules of Practice of the United States Bankruptcy Court <br />for the District of Utah, objections to the Motion must be <br />submitted in writing, filed with the Bankruptcy Court, and served <br />upon the undersigned counsel on or before Tuesday, September 21, <br />1993. Absent timely filing and service of objections, the <br />hearing may be stricken and the relief sought in the Motion may <br />be granted by the Court without further notice or hearing. <br />Additionally, upon the resolution of any timely filed and Nerved <br />objections, the hearing may be stricken and the relief sought in <br /> <br /> <br />2 <br />
