Gerity, P.E. <br />(see attached Affidavit), it has come to our attention that Basin <br />Resources, Inc. ("Basin") operator of the Golden Eagle Mine, in Las <br />P,nimas Couni.y, Cviorado, [ReviSedj rermit No. ~-dl-vl3 (permit <br />revision submitted September, 1989; approved July 2, 1990), has <br />failed to comply with a number of provisions of its current mine <br />permit under the Cclcrado Surface Ccal Mining Reclamation nct, <br />C.R.S. §§ 34-33-101 -137 (1984 Repl. Vol. & Cum. Supp. 1992), the <br />Regu'_atiers of t!:e ^_olcraao Mi^ed Tand Reclamation Eca=~ fo= Cccl <br />Mining (August 30, 1980; revised June 30, 1991) [hereinafter <br />"Reg."] and the Co'_or~ao *xined Land Reclamation Act, C.R.S. §§ 34- <br />32-101 -127 (1984 Repl. Vol. & Cum. Supp. 1992). <br />Such failures to comply include, but are not limited to, the <br />following: <br />1. Failure to file a subsidence survey and subsidence <br />monitorirty- plans for areas outside the renewable resource Zone <br />which is defined as the alluvial valley floor of the Purgatoire <br />River: C.R.S. § 34-33-111(1)(c), (d),(i); Reg. § 2.05.6(6); <br />2. Failure to adopt measures to prevent subsidence and <br />maintain the value and reasonably foreseeable use of surface land: <br />C.R.S. § 34-33-121(2)(a); _ <br />rw~,ve a xr~ue rte.. <br />
