Long <br />Division Director <br />In your letter addressed to Mr. Hernandez of the Division, dated <br />10/31/93, you express disappointment with the Division due to the <br />apparent lack of progress toward reclamation of the revoked TBM <br />site. The Division wishes to assure you that we are pursuing <br />reclamation of the revoked TBM site. <br />At the time of the 9/1/93 TBM site inspection, at which you and <br />Mr. Frank Bartlett attended, the Division discussed with you the <br />plans for reclaiming this site. These discussions are documented <br />in the Division's inspection report, remailed to you and <br />Mr. Bartlett. At the time of the inspection, the Division <br />believed there would be little problem with current <br />landownership, and intended to send copies of our proposed plans <br />to the specific landowners that would be affected by our proposed <br />operations. Current landownership records from the Las Animas <br />County Assessor's Office, however, identify current land owners <br />but do not define specific boundaries of ownership. Current <br />Las Animas County records indicate overlapping boundaries of <br />ownership in Section 15, between A.L. Cicia and Mark W. Ogrady. <br />In Section 22, the boundaries are again not defined between the <br />properties owned by Mark W. Ogrady and Gene and Nancy Chappie. <br />In our letter to the landowners, dated 10/15/93, we asked for <br />specific ownership boundaries to determine which land owners to <br />approach for comments conce~'iiing specific reclamation issues. <br />The Division has provided copies of these letters to your office. <br />The Division has received one phone reply and a copy of the <br />warranty deed from one of the four land owners contacted by the <br />10/15/93 letter. The Division is waiting for reply by the <br />remaining three land owners. <br />STATE OF COLORADO <br />
