r i <br />1( <br />1 <br />10:30 a.m., or as soon thereafter as counsel may be heard, in <br />Judge Boulden's Courtroom located on the third floor of tlhe <br />Federal Courthouse Building located at 350 South Main Street, <br />Salt Lake City, Utah. The Motion requests approval of a <br />settlement of the above-captioned adversary proceeding between <br />the parties. CF&I brought this action against Picoma alleging <br />that certain transfers made to it constitute avoidable <br />preferences under 11 U.S.C. § 547(b). The parties have a~~reed to <br />settle the matter with Picoma making a payment of $14,000.00 and <br />waiving all claims against the Debtors' estates. Copies of the <br />Motion and the related Settlement Agreement may be obtain~ad by <br />request from the undersigned counsel for CF&I. <br />PLEASE TARE FURTHER NOTICE that, pursuant to Rule !i23(b) <br />of the Rules of Practice of the United States Bankruptcy court <br />for the District of Utah, objections to the Motion must bee <br />submitted in writing, filed with the Bankruptcy Court, anti served <br />upon the undersigned counsel on or before Friday, Decembez- 3, <br />1993. Absent timely filing and service of objections, the: <br />hearing may be stricken and the relief sought in the Motion may <br />be granted by the Court without further notice or hearing. <br />Additionally, upon the resolution of any timely filed and served <br />objections, the hearing may be stricken and the relief sought in <br /> <br />2 <br />
