DEPARTMENT OF INTERIOR <br />OFFICE OF SURFACE MINING <br />RECLAMATION AND ENFORCEMENT <br />NOTICE OF DECISION <br />AND AVAILABILITY OF A TECHNICAL <br />AND ENVIRONMENTAL ASSESSMENT FOP, <br />BEAR COAL COMPANY'S <br />BEAR #1, q2 8 q3 MINES <br />GUNNISON COUNTY, COLORADO <br />/'1 <br />The United States Department of Interior, Office of Surface Mining Reclamation <br />and Enforcement, has approved, with stipulations, a five-year permit for Bear <br />Coal Company to mine coal. <br />The Bear Coal Company has operated coal mines in Gunnison County 10 miles <br />northeast of Paonia since 1934. Their current operations (Bear ql & q2) are <br />in the process of being closed with portals being sealed and reclamation <br />undertaken. The applicant is proposing to commence mining at the Bear #3 mine <br />(formerly the abandoned Edwards mine) located immediately south of Somerset, <br />Colorado. This operation will produce about 275,000 tons of coal per year <br />from the Paonia "C" member of the Mesa Verde Formation using a room and pillar <br />mining technique. The proposed mine will underly some 287 acres and disturb <br />for surface facilities B acres of previously disturbed land. <br />Any person with an interest which is or may be adversely affected, mqy request <br />an adjudicatory hearing on the final decision by August 16, 1982 after this <br />notice in accordance with Section 514(c) of the Surface Mining Control and <br />Reclamation Act. Any hearing will be governed by 5 U.S.C. Section 554. Department of the Interior <br />4015 Wilson Boulevard <br />Arlington, Virginia 22203 <br /> <br />Pursuant to Sections 1501.4(c) and 1506.6 of Title 40, Code of Federal Regula- <br />tions, notice is hereby given that the Office of Surface Mining Reclamation <br />and Enforcement (OSM) has completed a Technical and Environmental Assessment <br />on the mining plan for the Bear ql, q2 & #3 mines, Gunnison County, Colorado. <br />OSM's recommendation, approval of the plan and permit application with stipu- <br />lations, is in accordance with Section 510 and 523 of the Surface Mining Con- <br />trol and Reclamation Act (SMCRA). OSM's analysis shows 'hat no significant <br />environmental impacts would occur if the applicant's proposal is approved. <br />~i~ ~ . , <br />
