?ermit Plumber CO-0068, ( ) ?aae 3 of 7 ~,~ Sec. 9 The penittee shall dispcse of solids, sludge, filter backwash, or pollutants removed in the course of treatment or controi of waters or emissions to the air in the manner required by the approved Colorado State ?roaram and the Federal Lands ?rogram and ~nhich prevents violation of any other applicable State or F°:eral law. Sec. 10 a. In accordance with any term of the permit as necessary to pre- vent significant, imminent environmental hen to the health and safety of the pubiic; and b. Utilizing any methods specified a5 conditions of the permit by the Colorado Mined Lands Reclamation Division (C;9LRD) and OS;1 (if any) in approving alternative methods of compliance with the performance standards of the Act, the approved Colorado State Program, and the Federal Lands Program. Sec. 11 The permittee shall provide the names, addresses, and telephone numbers of persons resportsihie far operations ~lrtder the pemit to wham notices and orders are to be delivered. Sec. 12 The pernittee shall comply with the provisions of the Federai ',Dater Pollution Control Act (33 U.S.C. 1151-1175) and the Clean Air Act (42 U.S.C. i401 et seq.). Sec. 13 During mining operations if a pre~riously unidentified cuitural resources site is discovered, the operator shall ensure that the site is mat disturbed and shall notiry the reaulator~ authority. The operator shall ensure that the resource(s) is properly - evaluated according to the National Register of Historic Places eligibility a~iteria (36 CFR 60.6). Should a resource be - deternined eiigible for .listing in the National Register of Historic Places, the operator shall consult with and obtain the approvai of C^LRD and OS.4 conc_rning the development and implementation of mitigation measures as appropriate. Sec. 14 APP ~aLS - The Tessee shall have the right to appeal (a) under 30 CFR 787 from actions or decisions of arty official a the Office of Surface Mining; (b) under 43 C'R 3000.4 from an action or decision of any official of the 3u re au of Land Management; (c) under 30 CFR 290 `ram an action, order, or decision of any official of t`re U.S. ~eoloaical Surrey; or (d) under applicable r_culatiens f-rm any action or decisicn of any other official of the Depar~ent of the Interior arising in connecticn with this permit.
