Bear No. 3 mining plan ~das reviewed <br />by OSi•1 under the Colorado State Program and .the Federal Lands program (30 CFR <br />Chapter VII, Subchapter D). The tlineral Leasing Act portion of the MRP was <br />also reviewed for compliance with the applicable portions of 30 LFR Part 211 <br />(i.e., requirements and responsibilities of the Minerals Management Service <br />under the t4ineral Leasing Act). The Cf1LRD and OSt•1 developed the stipulations <br />which must be accepted by the applicant prior to issuance of a permit. These <br />stipulations will be made an integral part of the Bear R3 mining and reclama- <br />tion permit. <br />The U.S. Geological Survey (no~.•+ Mineral t•tanagement Ser~rice) provided v+ritten <br />concurrence with the proposed action on December 15, 1981 and March 24, 1982. <br />The Bureau of Land tanagement provided written concurrence on April 4, 1982. <br />The U.S. Fish and blildlife Service was consulted regarding threatened and <br />endangered species and provided opinions in their April 9, 1982 letter. The <br />State Historic Preservation Officer concurred with OSt4's proposed compliance <br />with 36 CFR Part 80 on April 16, 1982. A copy of each letter of concurrence <br />is enclosed. <br />The TEA, other documents prepared by C'4LRD, the company's application, and <br />correspondence developed during the completeness review and technical and en- <br />vironmental analysis are part of the mining and reclamation plan file. The <br />State Piotice of Decision in coordination with OSht v!as published in the news- <br />. paper on ~•1ay 17, 1982. <br />Based on this revie~.v, and as reflected in the attached recommendation package, <br />I recommend that you find that Bear Coal Company's permit application affir- <br />matively demonstrates that the conditions outlined in the Findings have been <br />complied v+ith and that you recommend approval for the Bear ~1,~2 and ~3 Mine <br />mining and reclamation plan and issuance of a five year permit. <br /> <br />ti <br />,'~..II` ~~, I. d <br />
