Mountain Coal Company has constructed eight sediment ponds and one <br />freshwater pond {FW-1). The ponds have been designed, constructed and <br />maintained in accordance with the requirements of 4.05.6 and 4.05.9. The <br />location of these ponds can be found on Maps 54 and 54B. The designs of the <br />ponds can be found in Exhibit 66. The ponds are located as neaz as practical <br />to the disturbed area and are not located within perennial streams according to <br />4.05.6(1)(6). <br />E. Acid-forming and Toxic-forming Spoil <br />Underground development waste from underground workings at the West Elk <br />Mine is handled as coal mine waste and placed on the Refuse Pile Expansion <br />area. No acid-forming ortoxic-forming materials are present in the spoil in <br />quantities significant enough to affect groundwater quality. Therefore, special <br />handling is not required for these materials [4.05.8(3)]. <br />F. Impoundments <br />Refer to the section regazding sediment ponds (4.05.9). <br />G. Surface and Groundwater Monitoring <br />The applicant will conduct monitoring of groundwater in a manner approved <br />by the Division. The groundwater monitoring plan is specified in Section <br />2.05.4, Groundwater Monitoring, and shown on Table 5, contained in Volume <br />1 of the permit document. Point-of-compliance monitoring wells are located <br />near the permit boundary at the approximate down-gradient extent of the B <br />and E-seams. Areas mined in the F-seam all lie up-gradient from outcrop (F- <br />seam down-gradient of mining does not leave the permit area). Alluvium is <br />monitored between the refuse piles and the river and data on down-gradient <br />alluvial water is available to the Division from the up-gradient alluvial well at <br />the Bear III mine, adjacent to the West Elk Mine on the west, immediately <br />down-gradient of the West Elk operation (4.05.130)). <br />2. The applicant will conduct monitoring of surface water in a manner approved <br />by the Division. The monitoring plan is specified in Section 2.05.4, Surface <br />Water Monitoring, and shown on Table 5 contained in Volume 1 of the permit <br />document (4.05.13(2)). <br />H. Transfer of Wells <br />No transfer of wells is proposed at this time. All monitoring wells will be <br />reclaimed prior to bond release [4.05.14 (3)]. <br />43 <br />
