Begej <br />Mined Land Reclamation Division <br />1313 Sherman St., Rm. 215 <br />Denver, CO 80203 <br />Dear Ms. Begej: <br />This letter is written notification that The Corley Company is hereby denying <br />Mined Land Reclamation Division or any of its agents or contractors any right <br />of entry to Sections 19 and 30, Township 20 South, Range 69 West of the 6th <br />P.M. except for inspection purposes and for enforcement of reclamation <br />requirements of that portion of said land for which Harrison Western <br />Corporation is responsible. Such denial of right„of entry shall terminate at <br />the satisfactory completion of reclamation of the Minerals, Inc. disturbed <br />areas in Section 24, Township 20 South, Range 7B~ West of the 6th P,M. <br />Satisfactory completion of reclamation shall be defined as completion of Phase <br />I and Phase II pursuant to Regulation of the Colorado Mined Land Reclamation <br />Board for Coal Mining. <br />In the event that MLRD should seek injunctive relief of this denial based on <br />public safety reasons, we would like to point out that we have sought <br />improvements to the east pit or fencing for at least six years. Recently we <br />completed fencing to prevent ingress to that area at our cost, and the <br />unstable highwall of the east pit had a massive slide about three months ago, <br />decreasing most hazards to the public.
