CC & VG, Carlton Project, -2- February 28, 1996
File No. M-80-244
The Division staff explained that our major concern was that the original parties to the
application receive notice and be allowed to participate in permit modification process.
Mike said that he would discuss the issue with staff and let the company know his
decision.
On February 8, 1996, staff met with the director. His direction to me was to tell the
company that the LLCS proposed change would need to be submitted as a permit
amendment. The drain cover layer could be submitted as a T.R., provided all the
original parties to the Carlton Project amendment were noticed. This would allow the
parties adequate opportunity for input and minimally delay the company. Also, that the
Division do the notice since under a T.R. no notices are required to be made by the
operator. The specification changes were to be handled as a T.R. (If someone objects to
a T.R. approval, they petition the Board for a hearing.)
M:\OSSammWtB0744. hbh
