<br />CC & VG, Carlton Project, -2- February 28, 1996 <br />File No. M-80-244 <br />The Division staff explained that our major concern was that the original parties to the <br />application receive notice and be allowed to participate in permit modification process. <br />Mike said that he would discuss the issue with staff and let the company know his <br />decision. <br />On February 8, 1996, staff met with the director. His direction to me was to tell the <br />company that the LLCS proposed change would need to be submitted as a permit <br />amendment. The drain cover layer could be submitted as a T.R., provided all the <br />original parties to the Carlton Project amendment were noticed. This would allow the <br />parties adequate opportunity for input and minimally delay the company. Also, that the <br />Division do the notice since under a T.R. no notices are required to be made by the <br />operator. The specification changes were to be handled as a T.R. (If someone objects to <br />a T.R. approval, they petition the Board for a hearing.) <br />M:\OSSammWtB0744. hbh <br />
