yards of spoil and results in a valley form considerably more steeply sloped <br />than the approved configuration. As a portion of its preliminary adequacy <br />review, the Division questioned whether the amended topographic configuration <br />compliments the natural character of the area. <br />The applicant responded to the Division's adequacy concerns, as included <br />within Exhibit 39 to the amended application, stating: <br />"Empire Energy Corporation is presently formulating <br />additional information concerning the reclamation plans <br />for the Williams Fork Strip Pit. This additional material <br />will address the specific concerns addressed in this <br />section of the PAR as well as the concerns raised on page <br />7, No. 5m and the Approximate Original Contour - Williams <br />Fork Strip Pit No. 2 concern within the Jim Pendleton memo <br />of October 9, 1986 portion of the PAR, This information <br />will be incorporated into Exhibit 24, Williams Fork Strip <br />Pit Reclamation Plan following approval by CMLRD. <br />Until such time that Exhibit 24 is approved by the CMLRD, <br />Empire Energy Corporation commits to reclamation of the <br />Williams Fork Strip Pit as described in the presently <br />approved Permit C-044-81 document." <br />This section of the amended permit application is in compliance for the Eagle <br />No. 5 and Eagle No, 6 mines. <br />XVIII. Coal Processing Waste and Non-Coal Processing Waste - Rules <br />3TS"SrSI- <br />The applicant prnsents a detailed engineering design for an approximately 1 <br />million cubic yard coal processing waste pile, located within the boundaries <br />of the Eagle Mine Complex permit area, as depicted on Map 25. Exhibit 21 <br />contains a design report for the coal processing waste pile pr-epared by <br />CTL/Thompson, Inc., and three supplemental documents pertaining to amendments <br />in design details and construction specifications, as well as results of <br />inspection certifications performed by the design engineer. Collectively, <br />these documents represent the amended design for the coal processing waste <br />pile at the Eagle Mine Complex. <br />The applicant also proposes to dispose of an additional 200,000 cubic yards of <br />waste in the abandoned Eagle No. 9 Mine's Portal Excavation, depicted on Map <br />25. The details of this disposal plan are presented on Map 28 of the amended <br />permit application, including a detailed site plan and appropriate <br />cross-sections. <br />The combined capacities of these two disposal areas represent the refuse <br />generated by the production of 60 million tons of coal. At the maximum <br />projected annual production rate of 4.0 million tons, this represents a 15 <br />year disposal capacity. <br />-59- <br />
