Empire Energy Corporation has requested that several road segments be retained <br />after mining. These roads include a 7200 foot segment of the haul road <br />connecting the Eagle No. 5 Mine with the coal processing waste pile and a 1050 <br />foot access road that leads southerly from the Eagle No, 9 Mine are to the No. <br />5A portal area (see Map 27), Surface owner consent to the retention of these <br />roads has been granted and the roads are compatible with the post-mining land <br />use. Therefore, the Division approves the retention of these roads in <br />accordance with Ruie 4.03.i(7) and 4,03.2(7). <br />Map 26 of the permit application does not accurately represent the culverts in - <br />place. Therefore, Stipulation No. 6 in the section on Ponds, Impoundments and <br />Diversions is written to include required updating of this map. <br />B. Support Facilities <br />Major equipment for coal handling at the mine are conveyors, breakers, coat <br />stockpiles, a silo, scales and the load-out. The load-out is adjacent to the <br />No. 5 portal, with an ancillary load-out in the town of Craig. No coal <br />washing facilities have been proposed. Ancillary support structures such as <br />offices, bathhouse, and substations, etc. have also been adequately described <br />in Section 4.04 of Volume 2 of the permit application. <br />C, Ponds, Impoundment and Diversion <br />Information on the sediment control system is presented in section 4.05 and in <br />Exhibit 18 of the permit application. Map 26 shows the location of the <br />components of the sediment control system. <br />A11 surface disturbance at the Eagle Mines is either routed to sediment ponds <br />designed to treat the water for suspended solids or has been appropriately <br />treated, such as covering with gravel, so that a small area exemption may be <br />granted. Runoff from the surface disturbance areas is routed to sediment <br />ponds by series of diversion ditches. A11 undisturbed drainage, where <br />practical, is routed by collection ditches around the undisturbed area and <br />discharges directly to the natural surface water system. Therefore, the <br />amount of runoff water needed to be treated by the sediment pond is <br />minimized. All ponds designed specifically to treat suspended solids of <br />disturbed waters have NPDES permits and effluent limits for the outlet of the <br />ponds. In the case of series ponds the latest pond in series has an NPDES <br />effluent limit. All ponds in the sediment control system have maintained <br />compliance with the NPDES effluent limits. <br />The mine water from the No. 5 Mine and from the proposed No. 6 Mine will be <br />routed though a series of sumps underground and ultimately discharged through <br />a piping system to the surface to a series of Lined treatment ponds. These <br />treatment structures are designed so that flocculants can be added if the fine <br />suspended portion in the water becomes high enough in content to cause <br />exceedence of the effluent limits. In the past the underground mines of the <br />Eagle complex have exhibited no problem meeting NPDES discharge limits and, <br />therefore, are not presently treated with chemicals prior to discharge. <br />-57- <br />
