FINDINGS OF THE ~~. ~~; ~ i . <br />COLORADO MINED LAND RECLAMATION DIVISION ~^=~~~ „ <br />FOR <br />EAGLE MINE N0.5, 5A AND EAGLE MINE N0.6 ' <br />~.~ '' <br />,I <br />Explanation of Findings ~ . <br />Pursuant to Rule 2.07.6(2) of the Regulations of the Colorado Mined Land <br />Reclamation Board for Coal Mining, the Mined Land Reclamation Division or the <br />Board must make a number of written findings prior to the issuance of a permit <br />or permit revision. These findings are based on information made available to <br />the Division that demonstrates that the applicant will be able to operate in <br />compliance with the Colorado Surface Coal Mining Reclamation Act and the <br />regulations promulgated pursuant to the Act. <br />This findings document is organized according to the major disciplines <br />reviewed during the permitting process. The written findings which must be <br />made by the Division are addressed under the appropriate discipline <br />subtitles. For example, findings concerning the protection of endangered or <br />threatened fish and wildlife species will be found under the subtitle of Fish <br />and Wildlife. Also, any specific approvals required to be made by the <br />~vis~6'~ro pursuant to Rule 4 and thus requiring a written finding pursuant to <br />Rule 2.07.6(2)(m) are discussed under the appropriate discipline subtitle. <br />I. Le al, Financial and Compliance Information - Rule 2.03 <br />The permit applicant for the Eagle Mines is Empire Energy Corporation, the <br />principle shareholder of Empire Energy Corporation is Cyprus Coal Company. <br />Empire Energy Corporation has not operated any other surface mining operations ,~ <br />under its name or any other name within the past five years. However, some of <br />the affiliated companies under Cyprus Coal Company have operated surface <br />mining operations. These companies include the Colorado Yampa Coal Company - <br />Coiorado Coal Permits C-81-071 (Eckman Park, Mine 1 and Mine 2) and C-84-062 <br />(Mine No. 3) and Twentymile Coai Company (Foidel Creek Mine, Permit C-82-056 <br />and Fish Creek Tipple C-ST-036). Cyprus operations outside the State of <br />Colorado include Plateau Mining Company (Utah DOGM Permit ACT/007/006), <br />Emerald Mines Company (Pennsylvania Permit 30841307), and numerous permits in <br />the States of Virginia (Knox Creek Coal Corporation) and Kentucky (Straight <br />Creek Resources, Inc., and subsidiaries of Cumberland Mountain Coal Company <br />including Bailey Hill Mining Company, Brownies Creek Mining Company and <br />Mountain Drive Mining Company). - <br />Information pertaining to the legal, financial and compliance requirements is <br />found in Sections 2 and 3, pages 2.03-1 through 2.03-23, of the permit <br />application. <br />Pursuant to Rule 2.07.6(2)(f), the Division has determined that proposed <br />operations will not involve surface mining of coal and as such the <br />documentation required by Rule 2.03.6(2) does not apply. <br />_l 2_ <br />{-- i~~~~ <br />I <br />
