Cottony <br />RE: CEMEX, Inc., Lyons Mine, Permit No. M-1977-208 Division Director <br />Comments from Fish & Wildlife Service: Wildlife Mitigation Plan Natural Resource Trustee <br />Dear Mr, Lohr, <br />The Division received comments from the U.S. Fish and Wildlife Service (USFWS) on October 22, 2004 regazding <br />the Wildlife Resource Assessment Report submitted by Michael Figgs of LREP on behalf of CEMEX, Inc. for the <br />Lyons Quarry. <br />In a letter dated October 14, 2004, the Division had required that CEMEX monitor the C-Pit pond on a daily basis <br />to record the presence or absence of any wildlife adjacent to or resting on the pond. If any wildlife is observed the <br />species, numbers and location should be noted. CEMEX was also advised to report such information to the DMG <br />on a quarterly basis. If wildlife is observed within the azea of concern, the DMG is to be notified within three (3) <br />working days of the observation. <br />The USFWS had similar recommendations regazding monitoring of the use of the C-Pit by migratory birds <br />including birds protected by the Endangered Species Act. Monitoring records in the form of a logbook that <br />includes daily entries of bird use, signs of injury, and mortality should be made available for review by the Service <br />upon request. In addition, injured or dead birds should be reported to the Service through the DMG. Attached is <br />the USFWS letter for further clarification.
